Please read these Terms carefully before using HyperLocalExpress. By creating an account or placing an order, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the HyperLocalExpress platform (the "Platform"), you confirm that you are at least 18 years of age (or have parental/guardian consent), have read and understood these Terms, and agree to be legally bound by them. If you do not agree, please do not use the Platform.

These Terms constitute a legally binding agreement between you and HyperLocalExpress Pvt. Ltd. ("Company"). The Platform acts as an intermediary marketplace connecting customers with independent local shops and delivery riders β€” we do not ourselves sell products or provide delivery services.

2. Definitions

  • "Platform" β€” the websites, mobile apps, and APIs operated by the Company.
  • "Customer" β€” a person who uses the Platform to browse and order products.
  • "Shop / Partner" β€” an independent merchant registered on the Platform.
  • "Rider" β€” an independent delivery partner registered on the Platform.
  • "Order" β€” a purchase request placed by a Customer through the Platform.
  • "Content" β€” all text, images, reviews, and data available on the Platform.

3. Account Registration

  • You must provide accurate, complete, and up-to-date information during registration.
  • You are responsible for maintaining the confidentiality of your login credentials (OTP, password).
  • You are responsible for all activity that occurs under your account.
  • Notify us immediately at support@hyperlocalexpress.in if you suspect unauthorized access.
  • We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
  • One person may register only one Customer account. Multiple accounts are prohibited.

4. Ordering & Payment

  • Orders placed on the Platform are subject to availability and acceptance by the Shop.
  • Prices displayed are set by the Shops and may change without prior notice.
  • Payment must be made at the time of order (online) or upon delivery (Cash on Delivery).
  • All prices include GST unless stated otherwise.
  • We use Razorpay as our payment processor. By paying online, you also agree to Razorpay's terms of service.
  • We do not store full card details. Payment data is handled by PCI-DSS compliant processors.
  • In the event of a payment failure where money is deducted, please contact us within 24 hours with your bank reference number. Refunds are processed within 5–7 working days.

5. Delivery

  • Delivery times are estimates and are not guaranteed. Traffic, weather, and other factors can cause delays.
  • The delivery address you provide must be complete and accurate. We are not responsible for failed deliveries due to incorrect or incomplete addresses.
  • You or an authorised representative must be available to receive the order. If no one is available, the rider will attempt to contact you. If unreachable, the order may be returned to the shop.
  • For Cash on Delivery orders, exact change is appreciated. Riders may not carry change for large denominations.
  • Riders on the Platform are independent contractors, not employees of the Company.

6. Cancellations & Refunds

See our Refund & Cancellation Policy for complete details. Summary:

  • Free cancellation within 5 minutes of placing an order (before Shop accepts).
  • Cancellation fee may apply after acceptance.
  • No cancellation after the order is picked up by the rider.
  • Refunds for valid complaints processed within 3–7 working days.

7. Prohibited Conduct

You agree NOT to:

  • Place false or fraudulent orders.
  • Harass, threaten, or abuse Riders or Shop staff.
  • Provide false information during registration or ordering.
  • Attempt to access other users' accounts or data.
  • Use automated bots or scrapers on the Platform.
  • Circumvent any security, rate-limiting, or access control measure.
  • Upload harmful, illegal, obscene, or infringing content.
  • Use the Platform for money laundering or any illegal purpose.
  • Attempt to reverse-engineer, decompile, or copy the Platform.

Violation may result in immediate account termination and legal action.

8. Intellectual Property

All content on the Platform β€” including logos, trademarks, software code, design, and text β€” is owned by or licensed to the Company and is protected under the Copyright Act, 1957 and Trademark Act, 1999. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

By posting reviews, photos, or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content on the Platform.

9. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that:

  • The Platform will be uninterrupted, error-free, or virus-free.
  • Products listed by Shops are of a specific quality (Shop is responsible for quality).
  • Delivery will occur within the estimated timeframe.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Company's total liability to you for any claim arising from use of the Platform shall not exceed the amount paid by you for the specific order giving rise to the claim, or β‚Ή500, whichever is lower.

We shall not be liable for indirect, consequential, incidental, special, or punitive damages, including lost profits or data loss, even if advised of the possibility.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka.

Before approaching courts, disputes should first be raised with our Grievance Officer (see Grievance Redressal). We aim to resolve complaints within 30 days.

12. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you via in-app notification and SMS at least 15 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
